1. General In these general terms and conditions, the following definitions apply: a. Patient: the person who has given Dental Practice Jacob Obrecht the assignment to perform dental work (treatments). b. Treatment: all treatments as specified in a quote or invoice sent to the patient in advance, and all actions directly related to the (verbal) assignment of the patient.
2. Applicability
2.1 Scope of terms and conditions These terms clarify the content of the terms that apply to the execution of the assignment between the patient and Dental Practice Jacob Obrecht and apply to every offer and agreement to which these terms have been declared applicable. Deviations must be recorded in writing.
2.2 The Agreement The general terms and conditions are an integral part of the dental treatment agreement(s) between the dentist and the patient. They are made available to the patient or their legal representative(s), are present in the waiting room, or can be sent upon request.
2.3 Conclusion of the agreement 2.3.1 The agreement is concluded at the moment the patient agrees to the treatment, verbally or in writing. 2.3.2 The estimates made by Dental Practice Jacob Obrecht are non-binding. The patient automatically agrees to the estimate at the start of the treatment.
2.4 Execution of the assignment 2.4.1 Dental practice Jacob Obrecht will perform the agreement to the best of its knowledge and ability and in accordance with the standards of good craftsmanship, in compliance with the codes of conduct and professional regulations. 2.4.2 Dental treatments fall under medical treatments. The (dentist) has a duty of care and no obligation of result.
3. Confidentiality, exclusivity, and protection of personal data
3.1 Confidentiality Dental practice Jacob Obrecht is obliged to maintain confidentiality towards third parties who are not involved in the execution of the assignment. This confidentiality obligation pertains to all information of a confidential nature that has been provided to Dental practice Jacob Obrecht by the patient. The obligation of confidentiality does not apply if, under the law, there is an obligation to disclose certain data.
3.2 Protection of personal data Dental practice Jacob Obrecht is entitled to share information obtained, including personal data, with third parties, such as colleagues, dental technicians, health insurers, and government agencies. Additionally, data may be used in anonymized form for research, publications, accreditations, presentations, the practice's own website, and patient information. Dental practice Jacob Obrecht ensures that the information cannot be traced back to the individual patient.
4. Third Parties The dentist is entitled to engage third parties in the execution of the agreement. He will exercise care in the selection of these third parties and, if reasonably possible, consult with the patient, with the exception of observers and dental technicians. The dentist is not liable for the actions of these third parties. Articles 7:404, 7:409, and 7:422 subsection 1 of the Civil Code do not apply.
5. Force majeure
5.1 Force Majeure Circumstances that prevent the execution of the assignment and that cannot be attributed to Dental Practice Jacob Obrecht. This includes, among other things: strikes, staffing shortages, lack of necessary raw materials or services, unforeseen delays with suppliers or other third parties, and general transportation problems. These circumstances are considered force majeure to the extent that they make the execution of the assignment impossible or unreasonably difficult.
5.2 Claim If a circumstance arises after Dental Practice Jacob Obrecht has already had to fulfill its obligations, it still has the right to invoke force majeure.
5.3 Obligations During the period of force majeure, the obligations of Dental Practice Jacob Obrecht are suspended. If that period lasts longer than three months, both parties have the right to terminate the agreement without the obligation to pay compensation.
5.4 Compensation If Dental Practice Jacob Obrecht has already partially fulfilled its obligations at the time of the occurrence of force majeure, it has the right to invoice the part already performed separately. The patient is obliged to pay this invoice as if it were a separate assignment, unless the performed part has no independent value.
6. Appointments, Cancellation, and SMS Service Appointments can be canceled free of charge up to 48 hours in advance. If not canceled in time, costs for the reserved time will be charged: €20 per 10 minutes. The patient will receive a reminder via SMS the day before the appointment. The patient cannot derive any rights from this.
7. Costs and payments
7.1 Payment Terms 7.1.1 These terms apply to all services, deliveries, and treatments by Dental Practice Jacob Obrecht. 7.1.2 Declared amounts are immediately due without discount. 7.1.3 Questions and complaints regarding invoices must be submitted in writing and with justification within 15 days of the invoice date. 7.1.4 Payment must be made within 30 days of the invoice date. In case of non-payment, the patient is in default and owes interest of 1.5% per month. 7.1.5 All collection costs are to be borne by the patient. 7.1.6 In case of payment arrears, Dental Practice Jacob Obrecht is entitled to suspend further treatment or require cash payment.
8. Treatment and Information The patient is informed in advance about the estimated costs of significant treatments. In the event of changes to the treatment plan or unforeseen complications, the dentist will inform the patient. The patient must provide all necessary information in a timely manner and in the desired form.
9. Liability The liability of Dental Practice Jacob Obrecht is limited to the amount covered by the professional liability insurance, increased by the amount of the deductible. If the insurance does not pay out, liability is limited to the invoice amount.
10. Warranty Conditions 10.1 Validity The warranty conditions are valid as long as Dental Practice Jacob Obrecht is active. 10.2 Warranty A warranty period of 1 year applies for fillings, crowns, and bridges, and prostheses, with certain exceptions. Regular check-ups are a prerequisite for the warranty.
11. Complaints Complaints about treatments should first be discussed with the practitioner. If this does not lead to a solution, the patient can make use of the complaint procedure of the ANT. For unresolved complaints, the patient can turn to the Dental Disputes Authority.
12. Applicable law Dutch law applies to all agreements. Disputes will be settled by the competent court in the district where Dental Practice Jacob Obrecht is located.
